1.1. You must be at least 18 years old to register or use any part of the Service.
1.2. By registering for or otherwise using the Service or any portion of it, you accept these Terms of Use. Registration without explicit acceptance of the Terms of Use is not possible.
1.3. You have three (3) years to notify Northe if you have any complaints about the Service. The Service includes, but is not limited to, our websites, the Northe mobile application (the 'Mobile App'), and any related services and products provided by Northe under its own brand or through a partner's, which may include, but is not limited to, identifying and navigating to charging stations for electric vehicles, initiating and paying for charging sessions (including through the use of cards or tags using RFID-technology), and providing certain information relating to charging session (e.g., pricing, availability, type of chargers available).
1.4. Northe reserves the right to change, add and remove features of the Service at any time without prior notice. These Terms of Use are applicable in any country and/or region that the Service is available in.
2.1. Northe processes your personal data in accordance with our Privacy policy.
3.1. Certain parts of the Service may be restricted for the exclusive use of businesses, entities, and/or individuals using the Service for their trade or business activities through an account designated for non-private use of the Service (a 'Fleet Account'). These Terms of Use shall be applicable on all use of the Service insofar as nothing else has been agreed to in writing by Northe.
4.1. To ensure that you have sufficient funds to pay for a charging session and are not using the service for fraudulent purposes, Northe reserves the right to charge five (5) euros (or the equivalent in local currency) when you add a new credit card, and before each charging session ('Pre-Authorisation'). The Pre-Authorisation will be reimbursed to the same method of payment within a few hours of completing your charging session. However, depending on your bank and card issuer, it might take up to seven (7) business days.If there's not enough balance to perform a Pre-Authorisation, your charging session will not be initiated.
4.2. If you have selected to pay for your charging session using a digital wallet as payment method (Apple Pay or Google Pay) the amount reserved may vary depending on the charging station, country, etc. The final amount reserved will be shown in the Mobile App before you start each charging session. If the fee from the charging session is less than the amount reserved, Northe will refund the difference. The refund is typically processed within a few hours after your charging session is completed. However, depending on your bank and card issuer, it might take up to seven (7) business days.
4.3. All prices shown in the Mobile App are inclusive of VAT. When using the Mobile App to initiate a charging session, the price will appear before the charging session begins. The cost of using the Service to charge your electric vehicle is based on one or a combination of different factors. These factors may be, but are not limited to, kWh used during charging, charging time, parking time, and session starting fees. You acknowledge that the final price depends on how you use the Service and that it's not always possible to calculate the final price before the charging session has finished.
5.1. You are responsible for ensuring that the registered payment method is valid, not blocked, has sufficient funds and that you are authorised to use it.
5.2. Payments from you to Northe are handled by one or more third party payment processor(s). Northe does not accept any liability for faults or disruptions in the payment process.
5.3. If debiting the registered payment method is not possible after a completed charging session, Northe may temporarily disable your ability to use the Service (e.g., by preventing you from initiating a charging session until full payment has been made). You may pay the outstanding amount by adding a payment method with sufficient balance.
5.4. If you fail to pay the full amount due, Northe reserves the right to prevent you from using the Service by suspending your user account and/or preventing you from registering a new user account. If Northe prevents you from using the Service due to payment failure, you are still obligated to pay any outstanding amount owed from using the Service. Northe will apply a default interest rate of 8% or the maximum default interest rate permitted by law (whichever is lowest) on any outstanding amount and issue a paper invoice. The paper invoice will be sent to the postal address registered in the Mobile App. If no postal address has been registered in the Mobile App, the paper invoice will be sent to the postal address where you are registered in the population register. If a paper invoice has been sent and full payment has not been received before or on the due date, a reminder notice will be sent out and You will be obligated to pay a reminder fee. If a reminder notice has been sent and full payment has not been received before or on the due date, Northe reserves the right to hand the matter over to debt collection, which will result in additional fees
6.1. The Billing Account function enables users to create and join one or more account(s) that are shared between multiple users (a 'Billing Account'). A Billing account allows multiple users to debit their charging to a single credit card or another payment method as selected by the administrator (the 'Administrator') of the Billing Account.
6.2. Users that have created or are connected to one or more Billing Account(s) may switch between the Billing Account(s) and their personal account in the Mobile App. Switching between accounts will change the payment method to that which is selected for each account.
6.3. When creating a Billing Account, you will be designated as the Administrator. The Administrator can invite other users to the Billing Account and select the applicable payment method for charging sessions. The Administrator may at any time remove other users from the Billing Account using the Mobile App. You acknowledge and accept that inviting other users to a Billing Account gives them access to paying for their charging in the Mobile App using the payment method selected by the Administrator of the Billing Account.
6.4. You acknowledge and accept that as the Administrator of a Billing Account, you will be charged for all fees resulting from charging sessions initiated by you or another user in the Billing Account. Northe shall have no liability for any charging session that results in the user being debited for the charging of another user connected to the same Billing Account. Debiting a Billing Account will generate a receipt that will be visible to the Administrator and the user that performed the charging session. The receipt will contain information about the charging session and the user that debited the Billing Account (e.g., name and address, time, duration and location of the charging session).
6.5. Northe reserves the right to freeze, modify the number of allowed Billing Accounts, and/or disable the Billing Account without prior notice.
7.1. You may order an RFID charging card and/or RFID charging tag ('Charge Key') through the Mobile App. The at any time applicable price to order a Charge Key is displayed in the Mobile App and includes VAT and shipping charges. The currency applied for the purchase depends on which country the Charge Key is ordered to. You will receive a confirmation of the purchase by email, and/or in the Mobile App. It is only possible to order the Charge Key to post addresses where the Service is available.
7.2. Northe may, from time to time, offer you a Charge Key free of charge, as part of a marketing campaign or otherwise. Unless otherwise stated in the Mobile App, you may only order one (1) Charge Key free of charge. Northe reserves the right to end an offer to order a free Charge Key at any time without prior notice.
7.3. You may at any time remove the Charge Key from your user account in the Mobile App. If you are connected to one or more Billing Account(s) you may change which account the Charge Key is connected to through the Mobile App.
7.4. If you receive a defective Charge Key, Northe will provide you with a new Charge Key free of charge. A Charge Key that you wish to return shall be sent to: Charge4go AB, c/o Convendum Kungsgatan 9, 111 43 Stockholm, Sweden.
8.1. Northe and/or Northe's partners may, from time to time, offer you a promotional code that can be activated in the Mobile App or otherwise generate a charging credit, a discount, credit or similar offer to your user account (a 'Promotional Offer'). Unless separately agreed, a Promotional Offer is a one-time offer. You may not be able to combine a specific Promotional Offer with another Promotional Offer. A Promotional Offer is nontransferable and may not be sold or refunded. If You receive a credit as part of a Promotional Offer, you are still liable to pay Northe for any fee incurred by you that exceeds the credit. The credit generated through the Promotional Offer must be consumed before its expiration date.
8.2. Northe reserves the right to modify and/or cancel a Promotional Offer. A Promotional Offer may exclude certain accounts (e.g. your personal account or a Billing Account) and/or be limited to certain parts of the Service or to a geographical area. Northe does not assume any liability for claims relating to Promotional Offers.
9.1. Through the route planner, users travelling between different locations can receive recommendations of charging stations along the designated route to charge their electrical vehicle ('Route Planner'). The recommendations in the Route planner are based on, e.g., car model, distance and battery capacity. The Route Planner is available free of charge in the Mobile App.
9.2. Depending on your car model, you may also be able to connect your vehicle to the Mobile App ('Car Integration'), enabling additional functionalities
9.3. Depending on your car model, you may also be able to connect your vehicle to the Mobile App ('Car Integration'), enabling you to view e.g., the car's charging level and approximate range.
9.4. The Route planner and Car Integration should only be used for an initial estimation. Actual battery usage is dependent on several factors that the Route Planner does not take into account and which may severely affect the range of the electric vehicle.
10.1. Northe Property is activated by your employer, leasing company or another third party that has agreed to pay for your charging sessions and/or reimburse you for electricity expenses from charging your electric vehicle (the 'Paying Party'). Northe Property is provided to you at no additional cost.
10.2. Through Northe Property you can connect a charging point through which you can initiate charging sessions by using a Charge Key or through your user account in the Mobile App (a 'Private Charging Point').
10.3. Northe Property is provided 'as is'. Northe cannot guarantee that Northe Property will be available without interruption, faults or malfunctions or the correctness, completeness, or accuracy of the information provided and transmitted through Northe Property.
10.4. Northe reserves the right to immediately and without prior notice disable Northe Property (for example, if the Paying Party disables Northe Property or if you are in breach of these Terms of Use).
10.5. Northe Property is only available for certain models of charging boxes and only such charging boxes ordered through a third party reseller approved by Northe.
10.6. If you are acting in the exercise of a profession or business, and the Paying Party has agreed to reimburse your electricity expenses for home charging, you may register for reimbursement. To register for reimbursement of electricity costs when charging your company car through Northe Property, you must add valid bank details and a charging tariff. You must also make sure that a Billing Account registered in the name of the Paying Party has been selected as active in your user account. If you initiate charging through a Charge Key, you must first connect the Charge Key to the correct Billing Account.
10.7. The bank details provided must be to a bank account in your name. The tariff shall reflect your actual cost for charging a company vehicle as decided between you and the Paying Party.
10.8. Unless otherwise agreed, the collection of bank details and reimbursement is processed through Brite Payments, a payment service provided by Brite AB. Northe Property and reimbursements are conditioned on your acceptance and adherencence of Brite's Terms & Conditions, available here.
11.1. It is the responsibility of the charging station operator to ensure that the charging stations are operating properly. Northe does not accept any liability for faults and defects in the charging stations or any tools (e.g., cables, converters, or adapters) belonging to the charging station.
12.1. When using the Northe Service you must always:
- Follow all instructions provided at the charging station and ensure that the charging process is performed correctly;
- comply with all applicable parking regulations at or in the area around the charging stations;
- not use the Service in bad faith of any error or fault affecting the Service, charging station or vehicle being charged;
- Make sure that the personal and payment information registered in the Mobile App is correct and up to date;
– protect your password and account information in the Mobile App;
- Make sure that no unauthorised person(s) have access to your user account and/or any Charging Card(s) without your permission; and- Make sure that all tools (e.g., the charging cable) used in connection with the charging are proper and working as intended.
12.2. If you suspect that your account has been hacked or that someone who's unauthorised has access to your user account, Billing Account, Charge Key or Private Charging Point you must immediately notify Northe by emailing: hello@northe.app
12.3. If You lose your Charge Key, you must immediately remove your Charge Key from your account in the Mobile App.
13.1. Northe reserves the right to restrict access to parts of, or the entire, Services and/or terminate your account, if you: (i) have given false information in order to deceive Northe and/or its partners, (ii) are using loopholes or vulnerabilities in the Service, charging station, or electric vehicle to deceive Northe or its partners, (iii) are creating more than one user account in order to receive multiple discounts, to avoid paying for charging sessions, or for other fraudulent purposes, (iv) Northe has reason to believe that a third party has unauthorised access to your user account, Private Charging Point, or a Billing Account to which you are the Administrator, or (v) in any other way fail to meet your obligations under these Terms of Use.
13.2. If Northe terminates your account for breach of this Agreement, Northe has the right to take necessary actions in order to protect Northe and/or its partners from damages, and you may be obligated to indemnify Northe from any costs or damage. For the avoidance of doubt, the termination of your user account does not exclude any financial obligation incurred towards Northe prior to the termination.
14.1. You have the right to delete your user account without any given reason. Deleting your user account can be done by contacting customer support or through the Mobile App. After you have requested your account to be deleted, you may not be able to re-enter your user account, use your Charge Key or any other parts of the Service. Deleting your account does not exclude any financial obligation you may have towards Northe relating to the Service.14.2. If You delete your account and open a new account, your charging history or any other information will not be transferred to your new account.
15.1. To the fullest extent permitted by law, Northe disclaims all representations and warranties with respect to the Service, whether express or implied. The Northe Mobile App and all services provided by Northe and Northe's subcontractors, service providers, and licensors, are provided 'as is' without any representations, conditions, warranties or of any kind.
16.1. Any limitation of liability in this section or otherwise stated in these Terms of Use shall not be construed as to exclude or limit the liability of Northe in the case of death or personal injury resulting from deliberate or negligent acts or omissions by Northe, its employees, legal representatives or subcontractors or otherwise limit Northe's liability to the extent liability cannot be excluded or limited by applicable law.
16.2. Northe is not liable for any indirect, incidental, special or consequential damages of any kind unless, and only to the extent, such responsibility is required by mandatory law.
16.3. Northe is not liable for any (i) damage caused by using faulty equipment or from any fault caused by a defect in the vehicle being charged, (ii) damages caused by unauthorised use of the Service, including use of the Service in breach of these Terms of Use, (iii) damages caused due to you or any third party not being able to use the Mobile App, the Charge Key or any other part of the Service.
16.4. When Northe is held liable (taking into account the above exclusions), Northe's liability shall be limited to €2,500 (two thousand five hundred).
16.5. The limitations to Northe's liability set forth in this Section will lapse if and insofar as damages are the result of intent or gross negligence by Northe.
17.1. Northe is not responsible for any changes in law, failure or delay in delivery, telephone and network connections, war, sabotages of charging stations, irregularities in the supply of electricity, strike, boycott, pandemic, epidemic, or other similar circumstances beyond the control of Northe.
18.1. These Terms of Use are binding between you and Northe the first time you register for or use any part of the Service and remain in force until termination by either you or Northe.
18.2. Both You and Northe may at any time terminate the Terms of Use. If you terminate the Terms of Use, Northe will block access to and delete any account connected to the User in relation to the Service. Terminating the Terms of Use will not exclude any financial obligation you may have towards Northe relating to the Service.
19.1. These Terms of Use shall be governed and interpreted according to Swedish law. If you are a consumer, applicable and compulsory consumer protection legislation of the country or region where you have your habitual place of residence shall prevail over Swedish law.
19.2. If You are a business, entity, and/or individual using the Service for trade or business activities, the exclusive place of jurisdiction for any dispute arising from the use of, or relating to, the Service and/or these Terms of Use is Stockholm, Sweden. This limitation does not apply if you are using the Service as a consumer in another jurisdiction.
19.3. If you are a consumer, you may also request that a dispute is submitted for online resolution to the European Commission Online Dispute Resolution platform available here.
20.1. These Terms of Use constitute the final and complete agreement between You and Northe in relation to its subject matter. These Terms of Use replace and supersede all previous terms of use and/or other agreements, written or oral, between You and Northe relating to its subject matter.
20.2. Northe reserves the right to change these Terms of Use at any time. You will be informed about changes to the Terms of Use by e-mail and/or through the Mobile App prior to the implementation of updated Terms of Use.
20.3. You can reject the change before the change is made and inform your disapproval to Northe. Upon rejecting the changes, Northe reserves the right to limit or cancel your use of the Service and delete your user account. Rejecting changes to the Terms of Use does not exclude any financial obligation you may have towards Northe relating to the Service. By continuing to use the Service you accept any updates and changes to the Terms of Use.
20.4. Earlier versions of the terms and conditions governing the Service will not be archived by Northe.
21.1. The provisions in this Section only apply if you are using the Service as a consumer.
21.2. You have the right to withdraw from any agreement you have made with Northe. The right of withdrawal applies for fourteen (14) days from the day you received possession of a physical product purchased from Northe. If you have purchased a service, the right to withdraw applies for fourteen (14) days from when you entered into the agreement.
21.3. You agree that you may not exercise your right of withdrawal for electricity consumed when charging through the Service, or any other services you have already used before invoking your right to withdraw.
21.4. To exercise your right of withdrawal, contact hello@northe.app. You may also use the withdrawal form available here.
21.5. If you exercise your right of withdrawal for a purchase of a physical product, you need to return the product within fourteen (14) days of informing Northe that you wish to exercise your right of withdrawal. Northe is entitled to deduct an amount equivalent to any diminished value of a product you have purchased. If you exercise your right to withdraw from a purchase of a service, Northe will deduct an amount equivalent to the use you have made of the service before your withdrawal.
21.6. Northe will reimburse the amount you have spent on the product/service (with deductions as set forth above) without undue delay provided that you (when applicable) have returned the product.
22.1. These Terms of Use do not limit your mandatory rights that cannot be waived according to mandatory law. Should any provision(s) under these Terms of Use be found to not be in accordance with applicable mandatory law, the remaining provisions shall not be affected.Thanks for reading through Northe's Terms of Use.
